To the judges of European supreme court of justice

Honorable and distinguished judges of European supreme court of justice

Respectfully,
We are a group of former members of pmoi( People’s Mujahedin Organization of Iran) who had MKO defectors letter to the judges of European supreme court of justicespent a great deal of their lives in Ashraf garrison and the other bases of this organization in Iraq and during those years we had been witnessing horrifying incidents and events which were all related to human rights and sentimental issues. Around 2 weeks ago on 21 of December 2011 ,you rejected the French government appeal of the European union verdict of 4 of December 2008 related to revoking terrorist label against pmoi and you emphasized and reiterated over delisting of this organization from the terrorist list and you called the French appeal request as an invalid request. In issuing of this verdict the role of Mrs. Shariston as the attorney of this file and dossier is very clear.

We know perfectly that most human rights issues as well as juridical and humanitarian issues throughout the world are contaminated to the wrong policies and any humanitarian principles are trampled easily for the sake of political and economical interests and the only thing which has lost its value is humanitarian and human rights values.

We know also that sometimes listing and delisting of the terrorist organizations has been affected by the contaminated and wrong policies and politics and if everything was implemented and carried out justly ,there was no need to put this organization(pmoi) in the European and US terrorist list in long interval from each other, because the performance of this organization during past 30 years is not covert for anyone.

Honorable judges

You are confronted with the organization which during the first years of the beginning of arm struggle had done hundreds assassinations on the streets ,so called revolutionary executions, and they have assassinated and slain more than hundreds of Iranian people by using bombs and automatic submachine guns ,in the pretext of their cooperation and involvement with the different Islamic republic organizations, on the streets and in mosques .

You are confronted with the organization ,which from 1981 till few years after the Kuwait war, has bombed and exploded governmental buildings and oil pipes and other places which as a result of that many innocent people have been killed and slain by them.

You are confronted with the organization which has implemented and carried out more than hundreds mortar attacks and missile operations on the streets of Tehran and other cities of Iran just few years before the fall of Saddam Hussein and they have targeted the buildings which both military personnel and ordinary innocent people ,like women and children, were in it.

You are confronted with the organization which has assassinated few American military advisers during the shah’s time in 70,s and had participated in hostage taking of American Embassy in Teheran ( they had a significant role in that operation which some video clips related to that event is available in YouTube).

You are confronted with the organization which its spiritual leader ,Massoud Rajavi, declared in official gathering that he will assassinate and slay the pmoi separated members and his critics on the streets of Europe if he does not succeed and fail in his cultic plans.

Honorable judges

You are on the position of judgment and many eyes are watching you. if one of those terrorist military operations happened and occurred in European cities , you would have silenced? Have not you condemned it as a terrorist act ?

Had not the leader of this organization , Mrs. Maryam Rajavi, declared self immolation order to her own members in the heart of Europe in 2003 and because of that order more than ten people set themselves on fire for her release? Do you know that simultaneously with Europe also in Ashraf Garrison the pmoi operatives had recruited for self immolation? Do not you think that these brutal and savage actions are not a terrorist danger for the future of Europe?

Honorable judges

Each one of us has lost one or more members of our families during these 30 years and also we have sacrificed and spent many years of our lives in this organization to fight against Islamic republic … we know well that the brutal and bloody policies of Massoud Rajavi during past 30 years has been precisely against the peaceful struggle and demanding democracy of Iranian people . we know very well that if any person who has perpetrated many crimes ,he or she can not be punished or killed on the alley or street by the order and the will of some one else without going to the court of law and without any trial and official judgment and this brutal action be called as a revolutionary execution and they call it as a street trial . you as the professionals in your position in judicial and juridical affaires know very well that these kind of brutal actions are the clear and apparent breach of human rights rules. No one can be punished without the trial and substantiation of the crime but the leaders of pmoi are not committed to such international rules and they have not showed any remorse of their brutal and bloody past in nowhere.

You honorable judges know that we had been members of this cult in the past and forcibly we knew such actions ( specially in the cold war which was the era of arm struggles) as an legitimate and lawful action because we did not have any idea about the breach of human rights , juridical and lawful issues because our thoughts were formed by the things which our leaders were saying to us, but you in the free and democratic world and society knew that such actions do not have any lawful and juridical legitimacy and we expect you to review the past of this organization carefully one more time .

Do you know that colonel Sayad Shirazi was assassinated and killed right in front of the eyes of his child on the street by the direct order of pmoi leader ,Massoud Rajavi? Who had put this colonel on trial and sentenced him to be executed and killed without any court of law and any official verdict even if he had done many crimes ? In which court of law such verdict and maximum penalty, death by firing squad, has been issued? Do you accept that a criminal , any criminal , be executed or assassinated in front of his terrified eyes of his own child? This is just an example of hundreds assassinations that pmoi has done.

Most of the pmoi assassinations had happened on streets and inside the mosques . we do not judge about the crimes which had perpetrated by the people who were assassinated but we are talking about the way of handling those trials and the punishments . Do you know that inside of the mosques women and children were present and some of those innocent people also were wounded or killed by the assassins? what about those innocents, women and children, who were wounded and killed?

Some of us were present in the scuffles which happened after the Kuwait war in Iraq. many times the homes and the properties of the ordinary iraqi people were targeted in the cities such as Touz Khormatou and Soleymanbak and Kefri and women and children and elderly people got injured and they were crying and begging the pmoi operatives not to target their homes . Do not you think that such actions are terrorist act and crime against humanity?

Honorable judges

Do the leaders of this organization has changed their violent strategy and policy? if it is true where have they declared it officially? is their forcible disarmament the criteria of their change? If it is true why during past 2 years hundreds of the pmoi members who were equipped with hand made baton , club , archery and wooden shields were sent by Massoud Rajavi direct order to fight against Iraqi soldiers? why those pmoi members by the direct order of Massoud Rajavi throw rocks and pieces of iron and fireballs toward the elderly parents of those pmoi stranded members?

Do you ,as honorable judges ,have enough recognition of the leaders of this dangerous religious cult? Have you spoken with hundreds of separated members of this cult to find more vital facts about their internal relations?

There is no doubt that the politics may be contaminated to corruption and we hope that the European courts specially the European supreme court of justice will always be free of any politics But there is an ambiguity for us that for what reason the French government appeal has been rejected?

Do not you think that the leaders of this cult are terrorist so how do you call and see those terrorist actions which had been perpetrated by pmoi during past 30 years ? and if you think that the leadership of this cult has changed its strategy and behavior what is your criteria and how do you confirm it? Is Rajavi ready to say in the Press and the Media that he is remorseful of all terrorist actions that he ordered and he says officially that he is responsible and has made a mistake? If they do not want to say it , so with what criteria can you be completely confident and sure that after all these events and residing of Massoud Rajavi and some of pmoi operatives in Europe, again they do not begin their terrorist actions against their dissidents and critics?

We ,as the former members of this dangerous religious cult , have been witnessing of many terrorist and criminal actions which have been planned by Massoud and Maryam Rajavi and we are ready to be present at any court of law that you mention to testify as witnesses . Most of those crimes has occurred against the dissidents and critic members and those crimes have been covert unfortunately . many members have lost their lives in Ashraf Garrison either under torture or by committing suicide and self immolation and more than hundreds of those members were incarcerated either in Ashraf garrison or Iraqi prisons such as Abughrib prison ,just because they were against the pmoi internal ideological revolution. Many of those pmoi incarcerated members in Iraqi prisons were exchanged as prisoners of war (POW) with Islamic republic. All those suicides which happened inside Ashraf garrison were because of inhumane pressures which the pmoi leadership exerted upon them.

So how is it possible to go through of all those facts without scrutiny and investigation and just by false claims of pmoi leadership and its officials, give the verdict? What about all those victims of pmoi terrorist actions , have they been mentioned in your verdict? Do not you think that before any verdict ,it was better to talk with some of those victims and let them share their views and experiences about pmoi with you? Have you been informed that during current year many pmoi members escaped from Ashraf garrison and took refuge in United Nation and among them there were women of leadership council ? was it not better for you and your verdict to talk with them first who are the most valuable sources and witness of the pmoi internal relations?

We are eager to see justice to what extent in the supreme court of justice and other European courts what comes first? We hope that with this verdict( which is only in favor of pmoi leaders and it does not solve any problems of those stranded members who have been victims of the pmoi leadership’s terrorist and inhumane policies) the future of the European youth will not be affected by the sectarianism and dangerous terrorist actions which may happen by the rise of religious cults and sects on European soil.

We, the former members of this dangerous religious cult, are ready to help you as much as possible to inform you more about these dangerous religious cults because we do not want that European youth like us become victims of such cults which are capable of brainwashing and forcing them to set themselves on fire and commit suicide for the sake of cultic thoughts and ideology. Fortunately the Iranian informed and intelligent girls and boys have shown perfectly during the recent years that they have recognized utterly these kind of cults, consequently for their own safety and security, they keep their distance from them as much as possible for that reason Rajavi has lost his hope on Iranian youth and instead he has counted on European youth.

Referring to Mujahedin-e Khalq terrorists enjoying widespread support within the United States Vincent Cannistraro told Habilian in a recent interview, “I agree that the MEK is a cult that interestingly is a terrorist group supported by neo-conservatives and others.”

Cannistraro who served as Director of Intelligence Programs for the United States National Security Council (NSC) from 1984 to 1987, said "some apparently think it’s not terrorism when it only kills people you don’t like."

Earlier last month, a group of the US congressmen asked the Obama administration to take the MKO off the US terrorist list and increase efforts to keep its terrorist elements in Iraq.

MKO’s bloody plan to leave Camp Ashraf

Everyone knows that the end year 2011 is the final deadline for the Mujahedin Khalq Organization’s stay in Iraqi soil where the group has occupied a 16000 –square meter area that MKO’s bloody plan to leave Camp Ashrafhas housed 3400 men and women. The group has played as a political actor for decades both before and after the fall of Baath regime, by making relations with Iraqi and European politicians and paying bribes to them. Now, we should think of weather the organization intends to leave Iraqi soil after thirty years or not?

To answer the question, I doubtlessly say:”Never”, because of my various conversations with over ten former members of the MKO. Following those talks I came into horrible conclusions.

There is a building called No.34 that houses Massoud Rajavi, according to former members including Abolfazl Fereidooni and especially Mrs. Maryam Sanjabi who had been a member of the Leadership Council of the MKO. My doubt vanished when I talked with Ali Qezel Qarshi. Mehdi Naderi and Shahram Heidary a few weeks ago. They said that the organization had ordered them to defend that building to the last breath. They even told them to defend it Ashura-Style [referring to Imam Hussein’s Martyrdom].

Some of former members also speak of underground tunnels and basements of the mentioned building. I can courageously say that the MKO’s arms are kept there. For instance, I quote from Mr. Ali Qezel Qarshi : ” in one case I saw more than 20 different types of arms such as mortar Kelashnikov ,after sometime I asked about those arms but I was told that they were given to Iraqi forces. I exactly knew that were never handed over to Iraqi forces.

Other former members speak of digging ditches in the camp and of making cold weapons in order to slow the move of Iraqi forces. Meanwhile they launch a propaganda attack against Iraqi government and create a massacre.[all former members],unanimously believe that the MKO does not intend to go and doesn’t hesitate to victimize all members to fulfill this objective.

Camp Ashraf is highly important to the group and to prove it, one can refer to some of Maryam Rajavi’s recent speeches in which she asserts Camp Ashraf as the most important strategic point for the organization and the MKO does not leave it at all.

To pressure Iraqi government, the MKO pays large amounts of money to European officials including Lord Corbett and the mayor of Ouver Sur d’Oise in France, some US senators and also some Iraqi officials with links to former Baath regime. They gathered signatures from some of our deceived Sunni countrymen. Iraqi Council of tribes issued a statement calling Iraqi government, United Nations and Red Cross to grant guarantee letters to save lives and properties of the group members. Besides, they collected some signatures of European civilians under the cover of human rights to disguise the MKO’s face.

False propaganda is absolutely one of the most important weapons used against the Iraqi government by the MKO. As it happened several months ago, some fanatic members of the group will commit suicide to instigate people’s emotions and then they will put the accusation on the Iraqi government for their killing and everything will take place by the side of building No.43 where the blood of murderers and innocents will mix. …

MKO status from the perspective of International Law

Article 14 of the Universal Declaration of Human Rights describes a right to enjoy asylum as a fundamental right of human beings, which is a limited right (comes with exceptions), because MKO status from the perspective of International Lawthe second paragraph of Article 14 limits the right to asylum by stipulating that "this right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations."

The position of the International Law towards the refuge and refugees has changed from the very beginning of the UN foundation in 1945, after the end of the Second World War, with regard to the changes and developments of the international community.

One year after the foundation of United Nations, on December 1946, the General Assembly passed a resolution to establish “International Refugee Organization”. It was a temporary organization of the United Nations (UN), which itself had been founded in 1945, with a mandate to repatriate or resettle European refugees to their homeland. Those who had been immigrated or moved to other countries due to the outcomes of the war. International Refugee Organization (IRO) was dissolved in 1952 after resettling these individuals (about one million refugees).

Although human beings have been relieved of WWII, its consequences and postwar tribulations were being gradually appearing. Economic, political, and social conditions of most of the countries where such that a significant proportion of individuals who have been repatriated to their homeland by International Refugee Organization preferred to seek refuge in the countries other than their own. Therefore, on 10 December 1948, the United Nations General Assembly unanimously adopted the Universal Declaration of Human Rights; the Article 14 of which is about the right to seek and enjoy asylum:

(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.

(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.

After the dissolution of International Refugee Organization in 1950, the United Nations High Commissioner for Refugees (UNHCR) was established to address the new problems.

Subsequently, in 1951, Convention relating to the Status of Refugees, and in 1967, its Additional Protocol was approved by the United Nations. Also in 1967, the General Assembly approved the Declaration on Territorial Asylum.

As mentioned previously, Article 14 of the Universal Declaration of Human Rights describes a right to enjoy asylum as a fundamental right of human beings. This is a limited right (comes with exceptions), because the second paragraph of Article 14 limits the right to asylum.

Article 14(2) refers to “the purposes and principles of the United Nations” which are mentioned in the Charter of the United Nations paragraph 1 of Article 1, and the most important of which is “to maintain international peace and security”. It is of great importance that one of the chapters of the Charter (Chapter VII: Action with Respect to Threats to the Peace, Breaches of the Peace and Acts of Aggression) guarantees maintenance of international peace and security.

So we can say that the importance of maintenance of peace and international security is among the major priorities of the United Nations and the rest of its duties have to be implemented in a way that it does not being threatened.

With the resolution of the economic, political, and social crisis, above all lack of employment, the European and American countries gradually narrowed refugee admission, even though the number of asylum seekers soared.

The reaction of the countries was tightening rules on accepting refugees, e.g., coining the new term of ‘asylum seeker’ instead of ‘refugee’. To be brief, asylum seeker is a person who is seeking protection as a refugee and his/her refugee status has not yet been determined by the host country.

The most important issue and problem of the above definition from a legal perspective is that the right to asylum is an individual right; interpretation, expansion, or restriction of which has to be done along the lines of protecting the individual rights.

The term “Asylum seeker” as opposed to “refugee” actually restricts the people to fully enjoy a right as stipulated in the Universal Declaration of Human Rights. So, separating asylum seekers and refugees explicitly violates the Article 14, Article 1 (equality), and Article 2 (non-discrimination) of the Universal Declaration of Human Rights.

To solve the problem it is said that:

Although the right to asylum is an international right and is internationally confirmed, the practical identification and definition of that should be established separately by each country and with regard to the location and facilities of each of them.
Implementation of an individual/private right should not prevent that of public rights (the right to security, sovereignty, etc.). In a nutshell, private rights yield to public rights (Privatum commodum publico cedit).

As mentioned, since the Universal Declaration of Human Rights does not describe the right to asylum as an absolute one, the right to asylum should not preclude states from exercising sovereignty. As a result, governments with regard to their sovereignty and facilities have the right to accept asylum seekers or deny them.

At the present time, those governments which have a good reputation in accepting refugees have tightened rules and regulations, as compared to the past. In addition, they inform the UNHCR of the maximum number of refugees could be admitted by them, and they rarely accept more than the stated number. The discussion for legal grounds for such an action will be discussed in the second part of the article.

The current status and UNHCR’s approaches

As it is understood from the official documents of the organization known as Mujahedin-e Khalq (MEK/MKO) and its front organizations such as NCRI, residents of the Organization’s camps, which gathered in Camp New Iraq (formerly Camp Ashraf) when they surrendered camps to the US forces, had various motives for staying in MKO camps in Iraqi soil. Diversity of people and motives is too much. (page 19)

For example, National Council Magazine pages 17-56 (titled: ‘Mujahedin Prison’) Addendum 20 and 21 June and July 1986, which is written “Armed resistance: a report from behind the front lines, Manouchehr Hezarkhani” on the front cover. The author describes a visit to one the Organization’s camps.

The author claims that one of the camps of MKO in Iraqi Kurdistan “covers an area of 28000 square meters.” In addition to other sectors in the camp there are two additionally, quarantine and reception sections, which those who for whatever reason are willing to cooperate with MKO have to pass these two stages.

The author quotes the head of the camp as saying that the individuals are divided into seven groups:

Supporters who were away for a while.
Iranian soldiers fleeing the battlefront
The escapees whose final destination was Europe, but they have failed to fulfill their goals.
Affiliates of other opposition groups with urgent conditions (neither agree with their organizations nor with ours.)
Iranian fugitives from refugee camps in Iraq.
People who approach the camp due to their economic problems.
Recruits of the Organization “who do not tolerate our discipline, or do not agree with our political line or ideology.”(page 19)
MKO has had extensive and systematic efforts within the Iranian prisoner-of-war camps in Iraq, according to documents and Iranian POWs. We should add at least another item to the above list.

Residents of one of the foreign countries who have joined the MKO camps in Iraq on account of opposition to the government of Iran (ninth group).

Considering all the previously mentioned aspects, we should say that:

Firstly, if the United Nations High Commissioner for Refugees (UNHCR) duly interviews the members of the MKO in the camp one by one, should consider this classification.

Secondly, Iranian government claims to have documents and evidences revealing that some of the MKO members in Camp New Iraq are being prosecuted for non-political crimes. As mentioned in the very beginning of the article, such individuals do not have the right to enjoy refugee, relying on Article 14(2) of the Universal Declaration of Human Rights.

Thirdly, some of the MKO members have committed war crimes, especially breach of peace and security during the Iran-Iraq war, 1980-88. The MKO operation Foroughe Javidan (Eternal Light) against Iran is one of the most obvious breaches of International peace and security.

It seems to take so long for UNHCR to simply follow the mentioned classification, and it’s unlikely to succeed. Thus, the best option for UNHCR to expedite refugee status determination of MKO members in Iraq is to divide them into two groups:

Those who participated in the operations which breached the International peace and security.
Those who did not involve in such operations.
If the UNHCR admits the refugee of each of these individuals without considering their records and introduces them to one of the countries which accept refugees, then they commit some crimes against rules and regulations of the host country (such as self-immolation, spying against the host country, money laundering, organized crimes, etc.) the refugee processing system of UNHCR will be questioned. Moreover, it may even be charged with supporting those who have breached international peace and security.

Western supporters of MKO refuse to have them in their own countries

The Iranian foreign ministry called for the rapid expulsion of the terrorist Mojahedin-e Khalq Organization (MKO) from neighboring Iraq, and called on the European countries which support the terrorist group to shelter its members. Foreign Ministry Spokesman Ramin Mehman-Parast

"The grouplet’s (MKO’s) fate should be determined as soon as possible," Foreign Ministry Spokesman Ramin Mehman-Parast said on Tuesday, asking those European states which provide support for the terrorist group to transfer them from Iraq and shelter them in their countries.

The reason why Europeans support the MKO, but refrain from sheltering its members lies in the fact that "they like insecurity to remain in the regional countries but they themselves continue to live in security and support such groups", he reiterated.

Mehman-Parast described the European states’ behavior as unacceptable, and said those countries which claim to be advocates of human rights should confront the terrorist groups like the MKO.

The Iraqi government in late 2011 forced members of the MKO out of their main training camp in the Northern Diyala province.

According to reports, one of the ringleaders of the MKO announced that the MKO was about to start relocating its members from their headquarters to a new place in Iraq.

He added that the first group of MKO members were about to be transferred to a new place specified by the Iraqi government.

Iraqi Government Spokesman Ali Al-Dabbaq stressed on Wednesday that Baghdad had not extended the presence of the MKO in Iraq, dismissing western media reports that had alleged to the opposite.

"The deadline for MKO’s presence on Iraq’s soil has not been extended but the way they will leave Iraq has changed and will take place in two phases," Dabbaq stated.

"Based on the agreements made with the UN, the MKO members will leave Iraq’s soil in two phases, they will be relocated to Camp Liberty and then leave the Iraqi soil from the camp," Dabbaq said.

"As we have earlier announced, the MKO members will leave Camp Ashraf (now the Camp of New Iraq) by the end of 2011," Dabbaq underscored.

Based on the UN proposal, the MKO members will be moved to Camp Liberty base, the US former base near Baghdad’s airport.

Since the beginning of 2011, the Baghdad government has repeatedly assured Iranian officials and people that it is determined to expel the MKO from Iraq by the end of 2011.

Meantime, a report in December disclosed that the main leader of the MKO, Massoud Rajavi, in remarks interpreted as informally declaring war on Iraq cautioned that he would not allow Baghdad to expel the group from Iraq, and stressed that he will keep the MKO in the country even if it costs the lives of all the group members.

According to a report published by the Habilian website, Rajavi has ordered the commanders of Camp Ashraf (the MKO’s main training center located in Iraq’s Northern Diyala province) to be ready to resist against the Iraqi forces, saying that it would not matter if all Camp residents are killed for obtaining his desired goals.

He also ordered his commanders to strengthen the military positions at the camp and in the surrounding areas by erecting numerous bulwarks and hurdles around the Camp and be ready for a war with the Iraqi government.

The MKO is behind a slew of assassinations and bombings inside Iran, a number of EU parliamentarians said in a recent letter in which they slammed a British court decision to remove the MKO from the British terror list. The EU officials also added that the group has no public support within Iran because of their role in helping Saddam Hussein in the Iraqi imposed war on Iran (1980-1988).

The group fled to Iraq in 1986, where it was protected by Saddam Hussein and where it helped the Iraqi dictator suppress Shiite and Kurd uprisings in the country.

The terrorist group joined Saddam’s army during the Iraqi imposed war on Iran (1980-1988) and helped Saddam and killed thousands of Iranian civilians and soldiers during the US-backed Iraqi imposed war on Iran.

Since the 2003 US invasion of Iraq, the group, which now adheres to a pro-free-market philosophy, has been strongly backed by neo-conservatives in the United States, who also argue for the MKO to be taken off the US terror list.

your confirmation regarding not to accept and recognize the pmoi( People’s Mujahedin Organization of Iran) as a terrorist organization after the French government just and truth objection and appeal , there is no doubt that it is a very big juridical mistake and it seems that the European supreme court which the justice has been designated as its name , has trampled the name of justice in this case, and Iranian people will not forgive your mistake which it seems that is a political matter. Our reasons are as follows:

1. This organization( pmoi) from the beginning of its foundation has utilized the behavior of arm struggle as the main tool to gain the political power and since the Shah’s time , this organization has insisted on this behavior .

2. This organization, according to their own confirmation is the first organization which organized the suicide missions in the middle east and carried out those missions in Iran, the missions which became as pattern and sample for the terrorist organizations such as Al Qaida in Afghanistan and the other violent organizations in the middle east.

3. The pmoi by its leadership ,Massoud Rajavi in Iraq and Maryam Rajavi in Paris had begun its mortar attacks inside Iranian cities in 1987 ( 1376) which is the biggest and the most undeniable document and proof of their violent behavior against the ordinary Iranian residents , and they can not hide or deny any of those attacks as a result of tens of vital documents and proofs which are available.

4. The pmoi and its leadership in Iraq and in Paris has not declared yet officially and in any place by showing a reliable and clear document that they have set aside and abandon the arm struggle . the Iranian people’s mind and memory can not be fooled by the deceit and political play of the juridical authorities in Europe and by their deliberately evaluation of the Iranian as ignorant people which specially and practically the European supreme court of justice has done it in this case.

5. The symbol of arm and submachine gun as logo in their emblem since 40 years ago shows their violent thoughts and behavior which has not been changed yet.

Unfortunately you have reconfirmed the delisting of this organization( with the traits mentioned above) from the European union terrorist list and the Iranian people think that in any violent activity which this organization may implement perpetrate in future , the European supreme court of justice should see its share and role in it and they should sense its heavy burden on their conscience and this fact is not far from the Iranian people’s expectations.

As you know well that the Basque combatants in Spain recently according to an official statement declared their renunciation and abdication from terrorism and violence as a tool for gaining identity and political power and they declared it officially and openly and Spanish people and politicians will reevaluate the Basque combatants after their declaration.

During past years the Irish Liberation army also has chosen the political struggle as the main solution for reaching to its political objectives and as a result of that they disbanded their military wing. Today’s world move forward far from using political violence , and using sword and arm for exertion and indoctrination of the thoughts and beliefs on the people in the space era and 21 century is completely out of question .

If you as an important authority and justice seeker on the European soil has closed your eyes on pmoi terrorist activities and their mistakes , according to your heavy humane responsibilities ask this organization that if they truly believe in denunciation and banishment of the arm struggle as the main tool for compelling and the exertion of their political beliefs and also if they have abandoned the arm struggle for ever and like the civilized people throughout the world have accepted the political solutions to express their thoughts and beliefs and they are practically committed to it , they should declare it officially and openly for Iranian people and the people throughout the world and you should ask this organization to declare this transformation by an official statement . otherwise you should accept that you have been deceived by their false policies and their hired lawyers but their movement and activities are under vigilant Iranian people surveillance and they will not be deceived.

The bitter truth is that before of all the Iranian people have been paying the price of the terrorism and the institutionalized violence in mujahedin’s terrorist cult and this fact has begotten an irrecoverable and irreparable losses on Iran democracy path.

Former Minister urges trial of MKO members

Former Iraqi Oil Minister Ibrahim Bahrol-Oloum asked the country’s Judiciary officials to put the members of the terrorist Mojahedin-e Khalq Organization (MKO) on trial for their crimes against the Iraqi people. Former Iraqi Oil Minister Ibrahim Bahrol-Oloum

"We call on Iraq’s Judiciary to try anyone or any group who has committed a crime against the Iraqi nation," Bahrol-Oloum told FNA on Tuesday, adding that any move in this regard is considered as a positive response to the demands of the Iraqi people.

"All political groups and parties which hold power should cooperate with each other to put the criminals on trial," he underscored.

In relevant remarks in September, Iraqi Minister of Finance Baqir al-Zubaidi had strongly condemned the crimes committed by the terrorist Mojahedin-e Khalq Organization (MKO) against his nation, and stressed that the group’s ringleaders should stand trial before being expelled from Iraq’s soil.

"The MKO has committed many crimes in Iraq and for that reason the criminal leaders of this group should be tried before being expelled from Iraq," Zubaidi said at a meeting with Seyed Mohammad Javad Hasheminejad, the Secretary-General of Iran’s Habilian Association – a human rights group formed by the families of 17,000 terror victims in Iran.

"Before the process starts for their expulsion, Iraqi officials are required to take action on behalf of the Iraqi nation to swiftly probe and verify the crimes committed by this cult," the minister reiterated.

Mitt Romney, Strangely Unfamiliar With the MEK

During Mitt Romney’s last month’s lackluster debate performance with a town hall in New Hampshire, an audience member asked the potential Republican nominee if he supported Mitt Romneyefforts by prominent political leaders in Washington to remove the Mujahedin-e-Khalq, an Iranian dissident terrorist group, from the State Department’s list of designated terrorist organizations.

Romney responded: "I have not heard of the MEK, so I can’t possibly tell you whether I support the MEK. I’ll take a look at the issue."

If Romney has truly never heard of the MEK, he won’t have to go far to learn more-his own special advisor on foreign policy, Mitchell Reiss, is a leading advocate for the group. In the past, the MEK directed bombing campaigns in Iran, but the group was de-listed from the European Union’s list of terrorist organizations in 2009 and would like America to do the same.

Reiss, the president of Washington College, issued a call last spring for removal of the MEK from the terrorist list, saying: "Time is running out, lives are at stake. For the United States this is a case where American interests of opposing the regime in Tehran are entirely consistent with American values of freedom and democracy."

In October, Reiss spoke at a policy briefing on the MEK. In fact, Reiss attended an MEK event just this past weekend.

The issue is hardly under the radar. Andrew Card, John Bolton, Rudolph Guliani, and Tom Ridge have all advocated for the MEK’s removal from the State Department’s list of terrorist organizations. Democrats like Bill Richardson, Patrick Kennedy, and Wesley Clark, have issued similar pleas.

Mr. Martin Kobler,

With kind respects and best wishes for your task regarding the issue of the inhabitants of Camp New Iraq (formerly Ashraf garrison), we would like to inform you of the following:

According to information gained from inside Ashraf garrison, Massoud Rajavi arranged a video conference with Ashraf inhabitants towards the end of September 2011. Participation in this session was mandatory for all cult members residing in Ashraf. In this conference, which lasted for 8 continuous hours, Rajavi tried to prepare his followers for the possible UN interviews beforehand.

He directly threatened members of his cult that during interviews they should not say or write anything but their names and the period they have been in Ashraf garrison, and should not mention anything about wishing to leave the base of the cult since this would produce severe consequences for them.

In his lengthy speech, Rajavi tried to frighten people against any and every possible UN action and emphasized that they would gain no benefit from the UN interviews and the UN intervention and it could even harm them. He told them that if they do anything except what he has asked them to do they would be arrested and handed over to the Iranian regime where they would be tortured and executed.

During his speech, Rajavi said that the Iraqi government, the EU, the UN, the ICRC and any other agency cannot make any decisions and the US is the only agency that makes all the decisions. In this respect he tried to give hope to his followers that with the US administration’s approval, the conditions that the organization used to enjoy under Saddam Hussein would be reinstated.

The information received from Ashraf garrison also indicates that all members have been put on a state of alert against the Iraqi forces and specific plans have been made in this regard. These plans are mainly defensive but some plans for ambushing the Iraqi forces and disarming them have also been made. The members are told that after disarming the Iraqi forces they should hand over the captured weapons to their superiors and wait to be told what to do next. It should be mentioned that during the April clash with the Iraqi forces some weapons were seized from Iraqi soldiers which are still being held by the Rajavi cult.

There has also been news that the leaders of the cult are actively seeking another clash with the Iraqi forces in order to eliminate some of their discontented members as they did in previous cases. This has been done several times in the MeK cult before. During the invasion of Iraq by allied forces in 2003, the leaders of the Rajavi cult murdered some of those who wanted to leave and later announced that they had been killed during the bombardments. In the following years as more dissidents fled Ashraf garrison it was revealed that of the over 50 persons that the MeK claimed were killed as the result of the bombardments, a maximum number of 5 had actually been killed in this way and the rest were eliminated by the cult itself.

What we would specifically like to draw your attention to is that inside Ashraf garrison the brainwashing sessions called “current operations” are proceeding with intensity. The reason for these delays and time-killing by the leaders of the cult and preventing the UN from carrying out its tasks is that they want to identify those who are potential deserters and also to mentally prepare their members for the interviews.

We therefore on behalf of the suffering families, who are the only right representatives of the inhabitants of the garrison and are truly following their best interests, urge you to adopt the following means.

– Arrange for the hundreds of families of members, who have been picketing outside the garrison for nearly two years and merely request to visit their loved ones which the leaders of the cult have denied, to visit the inhabitants during the transfer and interview process.

– Make sure that such meetings are carried out without the presence of the MeK officials. It is necessary for the International Red Cross and preferably the next of kin of interviewees to be present in order to gain the rapport and trust of the asylum seekers.

– Pass adequate information about their actual situation to these people since they have been away from the real world for many years and have no clue whatsoever about the circumstances outside the cult. Their only source of knowledge has been the cult leaders, so they must be well informed beforehand.

As before, Sahar Family Foundation declares its readiness for all possible cooperation. We would like to share all our resources in any appropriate way with the international organizations in order to reach a quick and peaceful solution for the dilemma of Ashraf garrison.

Saudi Arabia to harbor MKO terrorists

Saudi Arabia has reportedly accepted to give refuge to at least 70 members of the terrorist Mujahedin-e Khalq Organization (MKO) following the group’s planned expulsion from Iraq.

According to the reports coming from Baghdad, the US has asked its allies in the region, including Saudi Arabia, Azerbaijan, Jordan, Qatar and Pakistan, to give refuge to MKO members for conducting espionage activities on their soil.

The move came after the Iraqi government expressed determination to close Camp Ashraf, the base of the terrorist group located in the eastern province of Diyala and to expel all MKO members from the country. Iraqi Prime Minister Nouri al-Maliki has repeatedly said that the Iraqi government cannot permit a criminal gang to remain in the country.

Meanwhile, the terrorist group has also announced that it is ready for a gradual pullout from Camp Ashraf.

The Ashraf Camp, about 120 kilometers (74.5 miles) west of the Iranian border, currently houses more than 3,400 MKO members. The notorious camp was scheduled to be closed by the end of 2011, but a few days before the planned expulsion, the Iraqi government, under US pressure, agreed to a UN plea to extend by six months a year-end deadline to shut down the headquarters of the anti-Iran terrorist group on its soil.

Mujahedin-e Khalq Organization, which has carried out numerous acts of terror and violence against Iranian civilians and government officials, fled to Iraq in 1986, where it enjoyed the support of Iraq’s executed dictator Saddam Hussein and fought alongside Iraqi troops during the Iran-Iraq war.

The terrorist group is also known to have collaborated with Saddam in the bloody repression of the 1991 Shia Muslims in southern Iraq and the massacre of Iraqi Kurds in the country’s north.

Iran has repeatedly called on the Iraqi government to expel the group, but the US has been blocking the expulsion by mounting pressure on the Iraqi government.

While the MKO is designated as a terrorist organization under US law, and has been described by State Department officials as a repressive cult, The New York Times recently reported that Washington is mulling over removing the MKO from its terrorist watch list and giving refuge to its members.
