Massoud Rajavi

Rajavi’s big lies and misinformation apparatus

Rajavi’s disinformation apparatus, like its other misleading networks, are engaged in never ceasing propaganda, political and cultic activities in an attempt to influence on public opinion through the distorted information. The least thing observed in this ever-going blitz is ethics, that is to say, Rajavi is strictly adhering to Machiavellian codes to use available means to achieve objectives. What is most vivid in Rajavi’s ethical values in his conducts is novel definitions for these values like trustfulness, veracity and honesty.

To what extent can Rajavi be trusted in ethical considerations requires a thorough unearth of his ideological principles in this respect. In practice, it is a matter of fundamental inconsistency in the normative ethics and Rajavi defines ethics according to the interests and goals he attempts to achieve. In his newly defined ethical literature, the unethical can be identical with the ethical in the same way that wrong and right can be.

As defined in one of the organization’s early ideological, instructional pamphlets, “right can be transformed according to certain time and setting conditions”. Also “It might be possible that some means is right to use in certain conditions since it helps to achieve an end”. “There is another condition wherein the very same means is wrong because it can no more lead us to accomplish our ends.”

Thus, consistency, which is the hallmark of ethics, is absent in Mojahedin’s literature of ethics that is full of contradictions. Ethics requires consistency in the sense that our moral standards, actions, and values should not be contradictory. Examining Mojahedin’s ethical standards uncover inconsistencies that totally go against the standard values.

Stated by Rajavi, “all phenomena are constantly changing and moving and none are consistent”. No doubt, Rajavi’s inductions play a decisive role in his relations with the outside world and he has been facing a big challenge for his publicity as a violator of dominant ethical standards. Even Americans through multitudes of reports on Mojahedin have repeatedly reiterated the duality of the organization in its conducts and relations. Regardless of few advocates that try to criticize propagations they believe to be aimed at discrediting the organization, there is a broad consensus on the untrustworthiness of Mojahedin and that, they adhere to Machiavellian ethical codes to accomplish their ends.

As an evidence, take Rajavi’s message of November 4 in which he, concerning Camp Ashraf, states:
Mojahedin in Ashraf welcome the present Iraqi Government’s plan to be transferred to a third country from among the country members of the European Union or the United States.
Reading these lines, one may come to believe that the Iraqi Government has already conferred with the mentioned states to reach an agreement for the relocation of Ashraf residents. That is true that the Iraqi Government welcomes any country that will accept the organization but it has never named any certain host so far. Furthermore, the authorities have asserted that none of the 25 countries they have engaged in talks on behalf of Mojahedin to host it have agreed to accept the group. We do not know the basics of his claims but his misinformation will have their effect as he intends.

Here is another excerpt from his message:
The Iraqi Government must respect the rights of Ashraf residents according to the European Parliament’s Resolution issued on 24 April 2009 until they are transferred to the U.S. member countries of the E.U.

Some may infer that the message points to the alternates of the organization’s relocation settings agreed by the EU’s Resolution while it has nothing to do with the host countries but requiring the Iraqi Government to respect the rights of Ashraf residents. A look at the EU’s Resolution talks for itself.

Somewhere else he states:
The fighters of the National Liberation Army (NLA) surrendered 20 thousand pieces of arms and 20 thousand tones of ammunition to the American forces as a deal to give them protection until the ultimate solution.

Those who are unaware of the consequent invasion of the coalition forces and the seizure of the arms depots in Ashraf by American forces may be misled by such words that may imply the organization has surrendered its arms willingly to guarantee the camp’s security and that, the arms will be returned to them after its issue has been dealt with. It seems that Rajavi has learned his lessons associated with propaganda, conjuring lies and deceit from the known instructor of them, that is Joseph Goebbels; a master of the "Big Lie” who is quoted “If you tell a lie big enough and keep repeating it, people will eventually come to believe it”. And in fact, it has been the infrastructure of Rajavi’s propaganda machine at least during the past thirty years.

Iraqi Authorities' stance on the MEK

Al Rubaie: MKO members will be expelled

al Rubaie: Baath, al Qaeda want to show Iran as enemy

Former Iraqi National Security Advisor Muwaffaq al Rubaie said the former Iraqi Baath ruling party and al Qaeda want to show Iran as enemy to find justification for their activities. Al Rubaie: MKO members will be expelled based on determined standards

Al Qaeda and Baath party have always sought to make Iraq unstable and draw attention away from the fact that they are responsible for terrorist activities and killings in Iraq, he told ISNA.

“Baath party and al Qaeda are trying to show Iran as enemy of Iraq, in line with policies of Baath party, to have a justification regarding their measures in Iraq, Iran and Kuwait.”

Also regarding the issue of Mujahedin-e Khalq Organization (MKO) terrorist group, he said Iraq still insists that members of the group should not stay in Iraqi territory and they need to be expelled based on determined standards.

Iraq wants the members of the group to be either returned to a third country without use of force or to Iran, he added.

Elsewhere, regarding Iraq-Iran borders, he said the borders are secure.

Maryam Rajavi

Maryam Rajavi symbol of suppression and disappointment

I was surfing the Internet when I got to see the story of Maryam Qajar Azdanlou [Rajavi] on YouTube where the cult of Rajavi [MKO] has flattered her to the extreme extent. Although Mrs. Azdanlou is one single individual, the cult has portrayed her with various personalities such as a saint, heroic and political woman. What is the fact?

Maryam Qajar Azdanlou, actually inherited her Mujahed background from her sister Narges who, according to an Iranian journal “Partow e Iran”, killed herself by swallowing a cyanide capsule after she was at risk of being arrested by security forces of Shah, before the Islamic Revolution. After the revolution her sister Maryam was lucky to enjoy the advantages of the so-called presidency of National Council of Resistance. Then after the alleged ideological revolution in the 1980’s, she started a new wave of massacre in her movement. She even dedicated her emotional life and her family to sacrifice the fighters of resistance.

In the late twentieth century with her ideological revolution, she led her cult to its darkest days as in the middle-age. She ruined any freedom in Camp Ashraf and even all aspects of members’ lives; instead she replaced suppression and detection of opinion among them.

Maryam Qajar sharpened the edge of her suppressive sward towards the captured women of the cult. She has to deprive them from their basic rights to maintain her cult. She has theorized her revolution as the following: Human’s nature is originated from evil so suppression is a blessing for them. She humiliates the members and tries her best to capture their minds in depression and disappointment. Yes, Maryam Qajar Azdanlou is the symbol of suppression and disappointment for a dark future.

Her suppressive approach and her historical personality characterize her as a completely distinguished woman.

Maryam Qajar Azlanlou has dedicated her life for manipulating the members’ minds to change them into main generating motors of suppression and massacre of generations.
In 2003, she was jailed in France for 15 days but she was never treated badly there. The MKO made too much fanfare to release Maryam Rajavi, launching a wave of self immolations. But, what about those dissident members who are in the organization’s prisons and are tortured every day

It is funny that MKO labels Maryam as ‎Jeanne d’Arc who struggled for freedom of her country and was imprisoned and tortured because for the cause of her nation. Which part of Maryam’s life is similar to Jeanne d’Arc?

They also compare her with Martin Luther king. What a ridiculous comparison! Today former members are denouncing her true face so no one would believe her nonsense. As they described in their memoires of their membership in the cult, Maryam Rajavi orders the female members to bear hysterectomy operation in order to kill the least hope for emotions and family life in the women’s heart.

MKO terrorist leader in Norwegian Parliament

Iranian opposition leader in Parliament
But her organization is on the U.S. terrorist list.

In front of a small fan was the Iranian opposition leader Maryam Rajavi welcomed when she arrived in Parliament on Thursday. Rajavi is in Oslo for talks on the situation in Iran – both on theMKO terrorist leader in Norwegian Parliament human rights front, and when it comes to the country’s nuclear program. She would particularly ask for Norwegian support to a camp for exile iranians in Iraq.

“I came here to ask the Norwegian government for help prevent a humanitarian catastrophe of historical dimensions in the Camp Ashraf, Iraq, "said Rajavi.
Iranian opposition leader in Parliament But her organization is on the U.S. terrorist list.
Bipartisan support
Rajavi was very well received in the Parliament. A smiling Marit Nybakk (Labor) gave the Iranian exile leader a hug, and in foreign and defense committee, she met representatives from the Labor Party, Progress Party and the Christian Democrats.

Morten Høglund of Progress Party believed there had been a good and constructive meeting.
“We talked about the situation in Ashraf, but also about the situation in Iran in general. I think everyone who works with foreign affairs are concerned about the situation in Iran,” said Høglund after the meeting.

In the U.S. terror list
But Rajavi is a controversial figure: The group she leads, the People’s Mujahedin, should have been behind a series of terrorist acts against the Iranian and Western targets over the years. According to the United States, she leads a terrorist organization.

– What thoughts do you think is behind the designation of this organization as terrorist by the US?

– I have discussed with the Americans many times, and I think they are absolutely wrong. I am very pleased that the EU no longer has this attitude. I see this organization as an ally in the fight for a free and democratic Iran, "said Morten Høglund.

Terror
But religion researcher at the University of Oslo, Kari Vogt, looks completely different on the group leader Rajavi. Religious Researcher Kari Vogt says there is no doubt that the People's Mujahedin has conducted terrorist acts

Religious Researcher Kari Vogt says there is no doubt that the People’s Mujahedin has conducted terrorist acts.

– Have they been behind the terrorist acts?

– Of course, they have,. They are a military movement based in Iraq and who collaborated with Saddam Hussein. For this reason they are seen as traitors in Iran, "said Vogt.

Limited support
The organization was formed in the 1960s, and helped to overthrow the Shah-board during the revolution in 1979. But soon they also ended up in conflict with Ayatollah Khomeini and his regime.

In the 80s, they fought on Saddam’s side in the war between Iran and Iraq. Today, the People’s Mujahedin is the largest group in the Iranian opposition umbrella organization National Council of Resistance of Iran of which Rajavi is also the leader.

Although Rajavi said that she leads a credible alternative to the regime in Tehran, and that the Islamic Republic have forced the U.S. to lead the People’s Mujahedin to the terrorist list.

“We were labled as terrorists by Mullah’s office. This is a benefit Europe and the United States have given to mullahs. This party means the end of Khamenei and Ahmadinejads regime …"said Rajavi.

Authoritarianism motion
When the U.S. is trying to appease the Iranian regime, Vogt was asked, who believes that the statement falls on its own absurdity.

“ This is definitely not a democratic alternative to the present regime. On the contrary, they are known for great an authoritarian movement with an emphasis placed on personality cult, "says Vogt.

Removed from EU terror list
People’s Mujahedin was earlier this year removed from EU terror list after a long struggle in the legal system. In 2008, it provoked strong reactions among British politicians, including Home Secretary Jacqui Smith, then a judicial chair ordered the United Kingdom to remove the organization from its terrorist list.

Religious historian Kari Vogt believes nevertheless Norwegian politicians are betting on the wrong horse when they meet Rajavi.

“They have very limited support inside Iran. They have indeed supported in part by the exile community in Europe and the United States, but not inside the country. They do not represent the real opposition now. I think it is problematic, and in my opinion, politically compromised to meet this movement, "says Vogt.

Kari Vogt criticized the Norwegian MPs invitation to Maryam Rajavi

The well known Norwegian Religious historian and Middle East expert Kari Vogt criticized the Norwegian MPs invitation to Maryam Rajavi, the leader of MKO terrorist group.

Although the U.S. has put MKO on its terrorist list, they make use of the organization. Kari Vogt explains the issue:Norwegian Religious historian and Middle East expert Kari Vogt

First, it operates as US intelligence service in Iran what people of that type can do the best.
Secondly, MKO’s military capacity, which the Americans can take advantage of, and give them free passage.

Since the United States disarmed MKO after they occupied Iraq they have obviously invested a great deal, "says Vogt.

In the debate on Saturday she warned not to support the People’s Mujahedin. She said they have no credibility as champions of democracy and human rights, because they are an organization in exile, who are considered traitors among democracy advocates in their home country.

MEK Camp Ashraf

Secrets that may slink out of Ashraf

The countdown to quitting Camp Ashraf started, the case is a matter of great magnitude to turn attention to. The significance lays in the fact that at least for nearly thirty years the organization’s main bastion in Iraq has been active headquarters of militarism and, after the fall of Saddam, multilateral espionage because of its geopolitical location and Mojahedin’s skill in the Rajavi’s insistence on the strategic significance of the camp is a ploy to deflect the attention of the Iraqi Government from what is much noteworthy than a piece of land.profession. Although now an accumulation camp of some disarmed members of a once liberation army, Ashraf preserves its importance for Rajavi because of its potentialities in implementing suicide threats and formation of human shields that may lead to some crises. Possibly, Rajavi’s insistence on the strategic significance of the camp is a ploy to deflect the attention of the Iraqi Government from what is much noteworthy than a piece of land.

Going back over the organization’s past four-decade history demonstrates an undeniable fact that it did not hesitate to be engaged in espionage activities and attempts to infiltrate into the most sensitive security-protective establishments of the governments and social organizations to gather information it justified to be utilized for organizational, ideological and revolutionary interests but abused for terrorist and cultic purposes. For sure, during its three decade-long settlement in Iraq the country has been vulnerable to such activities which have been substantially expanded after the fall of Saddam to walk out of the encountered stalemates in collaboration with other terrorist groups. At least this information could habitually work as effective precautionary measures to react just in good time.

The Iraqi Government should have monitored Mojahedin to ascertain the breakdown of such potentiality but, unfortunately because of Americans sham conflict with Mojahedin who benefited their support, the government failed to make any scrutiny into the camp to discover what was really going on therein, where Mojahedin claimed to be a residing place and nothing more. Only an access to the pile of the existing documents in Ashraf can reveal to what degree the organization has been engaged in spying and intelligence activities that are tied to Iraq’s present and future, documents that Iraq may have classified as top secret and would expose Mojahedin to charges of treason.

Almost all the countries that were in some variance with Mojahedin had to deal with such trouble. France is one example that is still grappling with the consequences of Mojahedin’s presence on its soil. The reports of the DST (French Counter-intelligence), some parts of which have been released publically, well indicate that the country has hardly been immune to intelligence activities of the organization. Noteworthy about Ashraf, no responsible authority and forces have done a thorough search of the camp and the organization’s quantity of hardware and software that may contain sensitive documents and information which can be easily carried out of the camp unnoticed and under the cover of the organization’s properties. It will not be wrong to say that Ashraf is an unearthed centre of accumulated secrets and untold not only about the mysteries of Saddam’s reign but post-Saddam events that played a role to deter restoration of security to war and terrorism worn Iraq. Some do not heed warnings as they may believe that a disarmed terrorist group is like a fangless viper but Mojahedin are professionals in intelligence activities, a threat identical with terrorist operations and even exceed the danger.

Being disarmed, Mojahedin’s alternative for military operation has been an energetic involvement in intelligence activities. Of course, any probe may fail to discover very sophisticated equipment and apparatuses needed for such activities, but the organization’s potentiality easily solves the question of equipment as it has in the past and in the course of its struggle. Testimonies by the ex-members are the best evidences to fathom the organization’s intelligence menace. Engaged in a struggle against the Pahlavi’s regime, the organization exploited a variety of methods to intrude and eavesdrop on the regime’s systems, security and confidential conversations. Here are assertions of intelligence intrusions dating back nearly to thirty years ago exposed by Saeed Shahsandi.

We would eavesdrop on all SAVAK’s controlled six zones in Tehran and would record all their reports sent to their headquarters. We had also succeeded to have access to radio frequencies of SAVAK’s operation and hunting teams to gain information and thus, little by little we had an accumulation of accurate information about personal information of SAVAK’s ranking officers.

Our hold was so influential that we had exact information about the operation teams and knew many ranking SAVAK officers by name and tone of their voice.

Moniri Javid (a member of Mojahedin) had developed an ordinary tape recorder into a device that could automatically trace the radio frequencies and record conversations.
We had built devices as small as a pocket radio. It could be easily turned into a wireless radio and so sophistically it had been designed that hardly any professional technician of the Counter-Saboteur Committee could distinguish it from an ordinary radio.

I am not exaggerating when I say how we gathered information. I remember recording conversations of Dr. Iqbal’s driver checking in room in Mashad Hotel Hite for his mistress. Or the conversations of Abdol-Majid Majidi, a Minister in Hoveyd’s cabinet, and many other authorities of the ousted regime.

Our gathered information included a list of hundreds and thousands agents infiltrated into offices and organizations, accurate reports of the wanted or arrested people and students and the reports of many labor and social protests by SAVAK sent to its headquarters. So precise and up to date were the information that sometimes we had to deliberately change some parts to reduce the sensitivity and suspicious before publishing them for the public.

Reza Rezaee would reiterate that the gathered information were of the highest strategic importance to the organization and worth of a few lives to safeguard them.

Our eavesdropping equipment referred to as “silent” as well as a security bulletin published under the guidance of Sharifvaqifi effectively safeguarded the organization against unexpected strikes. The bulletin’s paper was so thin that could be easily destroyed if subjected to a danger.

As stated, such activities belong to the organization’s early days of struggle and no doubt it has made significant progress in many fields. Another point, it never lets precious experiences and potentialities idle whenever it has opportunities to utilize them for its interests; it is the extent of these intelligence and security information that remains a matter of obscurity. The Iraqi Government needs to be more watchful before the secrets and data slink out of Ashraf.

Mujahedin Khalq Organization

The process of MKO Decline

When in 1986 Massoud Rajavi ,leader of Mujahedin Khalq Organization went to Iraq with a lot of fanfare and hype, his flight from France to Iraq was called as heroic and was considered as a great victory for their so-called struggle against the Islamic Republic. The process of MKO Decline

The propaganda system of the organization failed to note that Rajavi actually fled to Iraq since the French government had ordered him to leave France due to the request made by Islamic Republic.

However, the move was titled as strategic because Iran was in war with Iraq at that time so the leaders of MKO had to spend a lot of time presenting reasoning for their supporters who were shocked by the organization sheltering before the enemy that had invaded their nation.

It was too difficult to justifythe treason MKO committed against its compatriots during the eight years of war between Iran and Iraq. When MKO succeeded to launch some operations against Islamic Republic buildings and authorities (in which a lot of innocent civilians were also killed) some other supporters could diminish their doubts and leave their homes in different parts of the world to join the group.

There were also a lot of other unfortunate recruits who were recruited by deceitful methods of MKO after they could not get refugee status in other countries and joined MKO as the last resort.
In 1986 when Islamic Republic accepted the UN ceasefire resolution 598 which consequently meant that Iraq could no longer be used as a place to launch operations , MKO started declining. The process lasted until the fall of Saddam Hussein. It was the worst incident that could happen to MKO since it was very clear that the ones who would achieve power in Iraq are those who opposed Saddam Hussein and his Baath Party and also his accomplice, Mujahedin Khalq who cooperated with him in the suppressive operations against Kurds and Shiites of Iraq. Thus, the situation got the worst.

MKO leaving Iraq means accepting a huge strategic mistake that the ideological leader made 30 years ago. And that’s what Massoud Rajavi has done in his latest message on the occasion of Aban 13th( the anniversary of the US embassy takeover in Tehran in 1979) he declared that MKO is ready to leave Iraq and of course he asked for 200 million dollars as blackmail.

As Camp Ashraf is the symbol of MKO’s existence and so –called ideology, losing Ashraf equals the loss of everything for the leaders. The members have always been told to defend Ashraf in any circumstances. They were ordered to lay down in front of vehicles driven by Iraqi Police when they raided Camp Ashraf on July 28th. They were told to sacrifice themselves to keep the Camp.

Now Rajavi’s new message has left the members in a new contradiction. Since to MKO members Rajavi is an infallible saint leader who never makes mistake; they are not allowed to think of the possibility of his fault.

The leader of the cult never cares about what will happen to Ashraf residents, who have to pay the price of their leaders’ ambitions. Once their opportunist leader sheltered near the notorious Saddam Hussein, they were convinced to go to Iraq too as a heroic, strategic move. Today, designated as a terrorist organization it is hard to make third government accept them!

Habilian Foundation

“Iran victim of terrorism” in Tafresh University

Habilian Association (Iranian terror victims’ families) held an exhibition in Tafresh University under the title of “Iran; victim of terrorism”.

As reported by Habilian Association website, keeping on its active presence in the universities throughout the country, this time Habilian Association held an exhibition about the crimes MKO has so far committed and their enmity with Iranian nation for the illumination of the young generation especially university students and academics in Tafresh.

In this exhibition which had, like other Habilian exhibitions in the universities, getting the university students familiar with Mujahedin-e Khalq terrorist cult on top of its goals, students with different political viewpoints visited the exhibition.

Some students who were new entries were either unaware of the existence of such a terrorist cult or at most heard that once there had been a band of Iranian traitors who had betrayed their own people during the Iraq-Iran war by fighting on the side of Saddam Hussein. Some students had limited information about MKO treasonous role in France and Iraq and also the assassination of top Iranian political figures during the early years of Iran after the Islamic Revolution.

In this exhibition new aspects of MKO long history of violence and terror were brought to the eyes of the students; images of MKO crimes in engineering operations , in one of which three guardians were tortured to death in a team house, killings of women and children in our cities, mortar attacks on residential areas, manipulation and brain washing methods they imposed on their rank and file members and a full list of names of more than 16 thousand terror victims over 12 thousands of whom were directly killed by MKO formed different parts of the exhibition.
The first comprehensive software program on MKO terrorism – Qabilian – which was very much welcomed by the students and playing the Wolves documentary which dealt with different dimensions of MKO treasons and the money which was given to MKO by the Ba’ath party in return for their betrayal during the war were other parts of the exhibition.

Providing the students with the images of students martyred by MKO, the most complete bank of books with topics concerning MKO, recognition and informing the students of MKO inter-cultic relations including weekly confessions, self immolations and compulsory divorces were other programs of the exhibition.

One of the aims of this exhibition was to make more familiar the younger generation with the crimes MKO has so far committed against Iranian as well as Iraqi nations and to let them know the fact that Iran has suffered serious damages from terrorist groups and is an oppressed victim of terrorism.

Iraqi Authorities' stance on the MEK

Iraqi official: Spain welcome to host Washington backed MKO

We can only wonder whether the army of lawyers acting on behalf of the Mojahedin-e Khalq cult does not in fact exceed the number of people in the organisation itself. Putting aside the obvious question as to where the money comes from to pay for two such armies, we can see that in recent weeks the MKO’s lawyers have been very busy.

The MKO, backed by the Israeli lobby and various neoconservatives, has tried to exploit a loophole uncovered in Spanish law in order to manufacture a ‘victory’ with which to dupe the cult’s victims – that is, its membership.

According to El Pais, the argument put to a Spanish Judge (who apparently does not read newspapers) to accept a court case on behalf of the Mojahedin-e Khalq terrorist cult against the elected Government of Iraq, is based on the well-worn fabricated lie that the MKO’s cult members in Iraq enjoy protected persons status under the United Nations Fourth Geneva Convention.
The UN has repeated ad nauseum that no such status applies to the group.

The Government of Iraq has so far ignored this attempt by the Israeli lobby to meddle in relations between Spain and Iraq, and has seen the reality through the clouds. Indeed, nobody who has any knowledge of the MKO would imagine that this is anything more than a three day propaganda offensive designed to shore up the remnants of the Saddam regime to irk the Iraqis who refuse to hand over their country to Saddamists.

An aside by an Iraqi official to Iran Interlink tells the story. “There is no mention of a Spanish judge in our constitution”, he quipped. ”But we are quite clear that the MKO is illegal in our country. If Spain would like to host the MKO on its own soil, they are welcome to them!”

Iran Interlink believes that the support of the Israeli lobby and neoconservatives given to the notorious terrorist Rajavi cult, and the concomitant misuse of the democratic institutions of European countries will not result in anything greater than the protracted suffering for the individuals trapped in Camp Ashraf in Iraq and their families who are unable to free them because of this support.

Report from EI Pais:

High Court takes on case against Iraqis accused of attacking Iranians
JOSÉ YOLDI, 02 December 2009
El Pais – English Edition

Justice system admits lawsuit despite no links to Spain or Spaniards
A Spanish High Court judge has accepted a lawsuit against a contingent of Iraqi forces who deliberately attacked a group of 3,500 unarmed Iranian civilians in a refugee camp on July 28 and 29, causing 11 deaths and more than 450 serious injuries.

This is the first suit involving the principle of universal jurisdiction to be accepted in Spain following the October 15 reforms that set limits on Spanish courts’ ability to try such cases. The new legislation establishes that the case must have some relevant link to Spain, such as the victims being Spanish nationals or the crime being perpetrated on Spanish soil.

But in this case there is no such connection. Joan Garcés, the lawyer who presented the lawsuit, invoked a segment of the law that adds "without prejudice to the international treaties and conventions subscribed to by Spain." The Fourth Geneva Convention for the protection of civilians in times of war obliges states to pursue serious violations of this principle anywhere in the world.
Article 146 of the convention specifies that each of the signatories "shall be under the obligation to search for persons alleged to have committed, or to have ordered to be committed, such grave breaches, and shall bring such persons, regardless of their nationality, before its own courts."
High Court Judge Fernando Andreu admitted this line of reasoning and petitioned Iraqi legal authorities to disclose whether there was already an ongoing case there relating to the attack on the Iranians on Iraqi soil.

The public prosecutor, Pedro Martínez, opposed letting the High Court take on the case because of the nonexistent link to Spain and due to the fact that there is no proof that Iraqi courts are not already handling the case.

But, given the lack of such proof, Andreu has decided that rather than rejecting the lawsuit outright, the court should first determine whether another penal case is already underway in Iraq, in which case the Spanish case would be dropped.
