The European Council announced on 31st January following the 2778th Council meeting of Economic and Financial Affairs that it has "decided to provide the PMOI with a statement of reasons for keeping it on the EU’s ‘asset freeze list’ of persons, groups and entities involved in terrorist acts, and to give the PMOI one month to present its views, together with any supporting documentation".
Nothing is violated and the council has decided to comply with the judgment of the Court of First Instance. That is exactly what MKO had claimed to have been deprived of, yet the group is frustrated over the council’s decision because the outcome contradicts what they expected.
As a reaction, reported by Iran Focus, a number of European parliamentarian advocates of MKO including Alejo Vidal Quadras, Luisa Morgantini), Manuel Dos Santos, and Edward McMillan-Scott accused the European Union of breaching a ruling by Europe’s Court of First Instance saying that the decision is “violating the rule of law and placing the Council’s opinion above that of the highest EU courts’ and called it “both scandalous and shameful”.
How a legal decision adopted by a body those parliamentarians are its members turns to be “scandalous and shameful”, terms commonly found in MKO’s literature, is a paradox that has to be explained by them. What do they have to say about other decisions taken by the council?
The decision, above all, has acted as a crushing blow over the body of the cult especially at a time when the insiders were being convinced to have achieved a big success. For sure, none of its European advocates can possibly influence the council’s decision since the council is wise enough not to unleash a dangerous terrorist cult and it is well aware that in no way can the cult exculpate itself of the provided reasons keeping it on the EU’s list.

Terrorist list – Follow-up to court ruling in OMPI case
The Council, following the judgment by the Court of First Instance on 12 December 2006 in the OMPI case (Organisation des Modjahedines du Peuple de l’Iran), decided to provide OMPI with a statement of reasons for keeping it on the EU’s asset freeze list of persons, groups and entities involved in terrorist acts, and to give OMPI one month to present its views, together with any supporting documentation.
The Council will consider any reaction by OMPI within this period of time, before taking a final decision.
It is recalled that on 12 December 2006, the Court of First Instance, in case T-228/02-, OMPI, v. Council, annulled Council Decision 2005/930/EC insofar as it had imposed an asset freeze on OMPI following its inclusion on the terrorist EU list. The Court found i.a. that the decision ordering the freezing of OMPI’s funds had not contained a sufficient statement of reasons and that the right to a fair hearing had not been respected.
The Council therefore decided to take the necessary measures to comply with the judgment.

According to reports, following the comments of Iraqi Government Spokesman on the expulsion of terrorist MKO from Iraq, the MKO leaders and members have sunk in deep fear and a critical situation rules their camp.
Despite pressures from pro-Baathist supporters of MKO and obstacles by occupiers, Iraqi officials acted decisively and announced the issue of MKO expulsion from Iraq. They have notified Iranian officials of their will.
Following the announcements by the spokesman of Iraqi government Mr. Ali Al-Dabbagh, terrorist gang of Rajavi has gathered its supporters to force the Iraqi government to accept its refugee status in Iraq.
Also, in order to boost the morale of its desperate members and in order to remind them of a promise that the US will use them along with its policies, they quoted a coalition commander in Iraq saying: "The comments of Ali Al-Dabbagh don’t reflect the positions of the US and we don’t agree with these comments. The position of the US on the rights of Camp Ashraf residents has not changed and Iraqi officials have been repeatedly notified of such position and the US forces are responsible for their protection."
Meanwhile, the officials of foreign ministries of the US and Britain have repeatedly stressed that the issue of MKO’s expulsion or its refugee status is something that should be decided by Iraqi government and that the US and Britain don’t interfere in such issues.

No change in EU terrorist list
TEHRAN, Sept. 10–Representative of the International Committee of the Red Cross (ICRC) to Iran Peter Stuker here Thursday said the Committee has got to know that many members of the terrorist Mujahideen Khalq Organization (MKO) want to return Iran.
Stuker told IRNA on Thursday that unfortunately, due to lack of security in Iraq and loss of some staff members, the ICRC did not deem it advisable to visit the Ashraf Refugee Camp, where the MKO agents are based.
He added that the ICRC representatives would take actions in that connection immediately after restoration of security to Iraq.
Families of the deceived MKO members in Ashraf camp staged a sit-in in front of the ICRC’s Tehran office and outside the Swiss Embassy, that looks after the US interests in Tehran, calling for measures to secure the release of their children from MKO captivity.
Meanwhile, the EU does not intend to remove the Iranian grouplet MKO from its terrorist list, EU diplomatic sources said here Friday.
The comments followed reports that the MKO is planning to hold a demonstration on Monday in front of the EU headquarters in Brussels to call for the removal of its name from the EU terror list.
"The MKO has been on the EU terrorist list since 2002. I am not aware of any formal moves to do that (to remove). There has been no movement in recent time on this issue," EU diplomatic sources told journalists on condition of anonymity.
"Some individual politicians have raised questions, but I am not aware of any initiatives to change the names on the terrorist list."
EU foreign ministers are to discuss ties with the Islamic Republic during their formal monthly meeting in Brussels on Monday.
The Brussels-based English weekly "European Voice" published a full-page, in what seems to be a paid, advertisement titled "Remove People’s Mojahedin of Iran (PMOI) from Terror List."
The ad claims that "100 parliamentarians, political figures call for the rally in Brussels on September 13".
Observers here are astonished at the ‘duplicity’ of Belgian and EU authorities in allowing members of a terrorist group to demonstrate openly.

In a meeting with Shirvan Al-Vaeli, Iraqi Deputy Interior Minister for Security Affairs, Gholam Hussein Mohseni Ezhei, Iranian intelligence minister, expresses regret for unrest in Iraq and promised that Iran would help its neighbor in establishing security.
In the Meeting, the issue of Mojahedin-e Khlaq organization, major armed Iranian opposition group based in Iraq, was also discussed.
The details of discussions have not been revealed, but the Iranian government has always asked for the removal of MKO’s camps in Iraq and extradition of its forces to Iran.
MKO, founded before the revolution of 1979, had troubled relations with the new government.
In early 1981, many of its leaders left Iran and settled in Iraq, that was at that time fighting with Iran.
Since that time, this armed group with more than 4000 organized members started border-crossing attacks inside Iran. Also, in the final days of Iran-Iraq war, they initiated the huge operation of "Forough-e Javidan", in which many of the members of the group were killed or captured.
The power and abilities of this group have decreased radically in recent years and they were disarmed after the US invasion against Iraq.
During past two years, after Iran issued public pardon for those MKO members who had not committed specific crimes, several MKO members returned to Iran.
